Customer Application Terms & Conditions
TO COMPLY WITH THE PRIVACY AMENDMENT ACT 1990, I/we the undersigned, acknowledge that the Company has informed me/us, in accordance with s.18E(8)(c) of The Privacy Act 1988, that certain items of personal information about me/us contained in this application and permitted to be kept on a credit information file might be disclosed to a credit reporting agency. Furthermore, I/we agree, in accordance with the following sections: s.18K (1)(b), s.18K(1)(c), s. 18K(1)(h), s.18N(1)(b) that use by the Company of the relevant information referred to in those sections may occur for the purpose of assessing this application. I/we confirm that I/we have read/or had fully explained to me/us the above and understand the implications of the Privacy Act 1990.
TERMS AND CONDITIONS FOR TRADING AND PAYMENT
FULL PAYMENT MUST BE RECEIVED BY TASTE FOOD DISTRIBUTORS BEFORE GOODS ARE DESPATCHED –
All outstanding invoices must be paid before new invoices are issued.
All accounts are pre-pay until otherwise agreed. If an account is granted and payment is not received we reserve the right to stop supply until payment is received and a $15 late fee will be applied each week after the 14-day due date. Accounts are opened on a trial basis and the first three orders are strictly COD. All claims/issues arising from invoices must be made in writing within 24 hours of receipt of goods.
We reserve the right to change the trading Terms & Conditions without prior notice however you will be notified of any such changes in writing.
You are recognized as duly authorized to apply for a business account/credit, and agree to the terms as set out above. In the event of this credit account being placed in the hands of a debt collector for formal demand and collection of monies outstanding, then it is agreed that this company/firm will pay all fees and disbursements that may be levied by that debt collector and late fees will be charged on all overdue monies.
Title to the goods shall not pass to the purchaser until all monies owing by the Purchaser to the supplier in Company of these goods have been paid and accordingly any sale of the goods by the purchaser to any third party will be made by the purchaser as agents for the supplier and the proceeds will be held in trust for the suppliers as its property. This agreement shall be governed and interpreted under the laws of the Australian State of New South Wales and the parties shall submit to the jurisdiction of the courts of that state.
In consideration of Taste food distributors granting credit to the business named in this application you agree to hereby jointly and severally be individually responsible for the payment of all monies now or at anytime and remaining unpaid by the said business.
